Oi, quick MUGEN question.
« on: June 26, 2008, 09:30:28 PM »
If I were to make an original game on MUGEN, y'know, no edits, no rips, nothin like that. Completely original sprites and music. And I programmed it on MUGEN. Would it be legal for me to sell that game?

Yes, but I don't think it wouldn't be legal to play the game as that would violate the terms that come with it. I could be wrong.

I don't think a company that doesn't exist, in the Bermuda post office will be able to take any action on you.

This one's a toughie. You'll definitley meet some people that will say 'yes', you can sell it, as the sprites, coding, etc is all your work. Then, you'll definitley hear 'no', because Mugen is a free engine.

I'm also certainly no legal expert either. :-[

Its illegal to play mugen after 2002 but we have to make chances.

Also its your own work you can set your own copyright on it as reu did on his character dragon claw.

Ah, so MUGEN's been illegal since 02? Then I guess I'd need to find a different program or engine or whatever it is..

Thanks.

Dragonclaw is different. This guy wishes to sell his game, which it seems he can't do. Reu sold merchandise of his character, but never sold anything more than DC's image.
Punctuation and capitalization can make the difference between "I helped my uncle, Jack, off a horse," and, "I helped my uncle jack off a horse."

92% of people have moved onto rap. If you're part of the 8% who thinks rap isn't music, sucks to be you.

Most newer stuff sucks, though.

Mugen will stay around. I mean if it was illegal to distribute the engine then randomselect would be down in an instant.

Though I don't really have a good idea about the copyright as it is void now.

I'm not 100%, but the MUGEN engine may fall under "abandonware". If so, there are no legal consequences for using, modifying, or distributing the engine free of charge. Selling it can still get you in trouble.

If you wanted to sell 100% original content to be used in MUGEN (chars, stages, etc) that were 100% made by you from scratch (sprites, code, sounds, everything), that would be legal. If Reu had wanted to charge to download Dragon Claw, he would have had every right to do so (although it would have quickly ended up on esnips anyway).

Charging for a 100% original full game would be legit, but you couldn't include the MUGEN engine itself in the download. Again, what ever you were trying to charge for would end up in someone's esnips folder in a day or two....

From what I've heard, there's no such thing as abandonware. That's just used as an excuse for pirating old stuff.

Abandonware is typically used for a term when a copyright holder no longer exists; it is still illegal to distribute the work, but no company legally exists to press charges against you.

If Capcom were to go out of business you could illegal distribute Street Fighter II without be sued by Capcom (which no longer exists.)

That is at least my understanding of it. Kriven, you may want to consult a lawyer, as I doubt anyone in the thread is an expert of copyright law (including myself.)
