I hate to play devil's advocate in this scenario due to the hypothetical possibility of a lawsuit but If I learnt anything from the release of streets of rage remake is that you keep circulate the tapes.

Say it gets "leaked" by a third party beta tester and the game is no where near complete. You can be held liable because you didn't forsee this and took preventive measures to keep it from happening.

Not saying you would go ahead with that and please ignore this if you believe it to be a really bad idea.

I disapprove of cease and desists as many publishers would rather sit on said IPs even if there have nothing noteworthy to release yet stamp out and innovative and original ideas that are developed as a labor of love and as a way to bring exposure to a new demographic.
